Abstract

The article hides the content of the right to free speech and tolerance of speeches directed at religious institutions. The possibility of criminal liability for offensive words directed at the race of others is discussed, considering the secularity and equidistance of the state, as well as the need to combat racism. It starts with the hypothetical-deductive method to demonstrate the consistency and inconsistency of some Brazilian jurisprudential positions in the treatment of religious freedom.
