Abstract

The ruling of the Supreme Court of May 8, 2017 tangentially examines the prohibition of registration as a trademark of symbols with religious content. This decision will allow us to review the position taken by comparative law on this issue. Then, we will try to resolve under what normative criteria it is possible to deny the registration of such signs in our country, having in view indeterminate legal concepts, such as public order, morals or good customs, which are included in the prohibition contained in article 20 letter k) of the Industrial Property Law.
